Terms of Service

These Terms of Service ("Terms") govern your access to and use of fitsyou.live, including its Chrome extension and web platform (collectively, the "Service"). The Service is operated by Anna Arndt, a sole trader (Einzelunternehmen) registered in Berlin, Germany, trading as House of Steam ("we", "us", or "our"). When you use fitsyou or purchase a subscription, you are contracting with Anna Arndt (House of Steam) — not with Google. Full legal and contact details are available in our Impressum.

By accessing or using the Service, you confirm that you are at least 16 years of age and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

fitsyou.live is a virtual clothing try-on tool that allows users to upload personal photos and garment images to generate AI-powered visualisations of how clothing items may look when worn. The Service uses third-party AI image generation to produce these outputs.

The Service is provided for personal, non-commercial use. Try-on results are illustrative only and do not guarantee how a garment will look, fit, or appear in real life.

To access certain features of the Service, you may be required to create an account. You agree to:

• provide accurate and complete registration information
• keep your login credentials confidential
• notify us promptly of any unauthorised access to your account
• accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:

• upload images of minors (persons under 18 years of age)
• upload images that are sexually explicit, violent, or otherwise unlawful
• upload images of individuals without their consent
• attempt to reverse-engineer, scrape, or extract the underlying AI models or infrastructure
• use the Service to create or distribute disinformation, deepfakes, or misleading content
• use the Service in any way that could harm, disrupt, or place an unreasonable load on our systems
• use automated tools, bots, or scripts to access the Service without our prior written consent

We reserve the right to remove content and suspend access for any violation of these rules, without prior notice.

5.1 Your Content

You retain ownership of any images you upload to the Service ("User Content"). By uploading content, you grant us a limited, non-exclusive, royalty-free licence to process and transmit that content solely for the purpose of providing the Service to you. We do not claim ownership of your images.

5.2 Generated Outputs

AI-generated try-on images produced using your inputs ("Output Content") are provided for your personal use. Ownership of Output Content is assigned to you to the extent permitted by applicable law. You acknowledge that similar outputs may be generated for other users using comparable inputs.

5.3 Garment Images

You are responsible for ensuring that any garment images you upload are either your own or that you have the right to use them. We do not verify the ownership or licensing status of uploaded garment images. Do not upload images protected by third-party intellectual property rights without appropriate authorisation.

5.4 Our Platform

All rights in the fitsyou.live platform, including its design, software, branding, and documentation, are owned by or licensed to us. Nothing in these Terms transfers any such rights to you.

The Service relies on the following third-party providers to function:

• OpenAI (image generation) — your uploaded images are transmitted to OpenAI's API to produce try-on results. OpenAI processes this data as a data processor under our Data Processing Agreement. OpenAI does not use API inputs for model training by default.
• Supabase (database and authentication)
• Cloudflare R2 (image storage)

Paid plans have not yet launched, so no payment processor is currently active. Once paid plans go live, this section and our Privacy Policy will be updated to name our payment processor.

Your use of the Service is also subject to the applicable terms and privacy policies of these providers. We are not responsible for the acts or omissions of third-party services beyond our reasonable control.

The Service is currently offered free of charge during our beta. Paid plans are planned but not yet available for purchase — pricing shown on the site is indicative and any "Upgrade" or plan-selection control will say so until checkout is live. Once paid plans launch, the following will apply:

• We (Anna Arndt, trading as House of Steam) will be the seller and merchant of record for paid subscriptions, billed through a payment processor named in our Privacy Policy at that time.
• Subscription fees will be charged in advance on a monthly or annual basis, as selected at checkout.
• Monthly usage caps (try-ons) reset at the start of each billing cycle and do not carry over.
• Unused try-ons in a given period are forfeited and are not refundable.

7.1 Refunds

Once paid plans launch, refunds will be handled as described in our Refund Policy. To request a refund, contact us at the address below.

7.2 Price Changes

We may change our pricing with at least 30 days' notice. Continued use of a paid plan after the notice period constitutes acceptance of the new pricing.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• the Service will be uninterrupted, error-free, or free of viruses or other harmful components
• try-on results will accurately represent how a garment will look, fit, or perform in reality
• the Service will meet your specific requirements

Use of the Service and reliance on its outputs is at your own risk.

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of profits, or loss of goodwill.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim, or EUR 50, whichever is greater.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under German law.

We process personal data in accordance with our Privacy Policy and applicable EU/German data protection law, including the General Data Protection Regulation (GDPR). We act as the data controller for personal data collected through the Service.

You have the right to access, correct, delete, or port your personal data. Requests can be submitted to the contact address below. For further detail on how we handle your data, please review our Privacy Policy, which forms part of these Terms.

You may stop using the Service at any time. You may delete your account via your account settings, which will trigger deletion of your stored data subject to our retention policy as described in the Privacy Policy.

We may suspend or terminate your access to the Service immediately, without prior notice, if we reasonably believe you have violated these Terms, or if we are required to do so by law.

Upon termination, your right to use the Service ceases immediately. Sections 5, 8, 9, and 12 of these Terms survive termination.

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law principles.

Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany. If you are a consumer, you retain the right to bring proceedings in the courts of your country of residence within the European Union.

The European Commission provides an online dispute resolution platform for consumer disputes, available at https://ec.europa.eu/consumers/odr.

We may update these Terms from time to time. When we do, we will update the effective date at the top of this document and, for material changes, notify you by email or via an in-app notice at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver: Failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.
• Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights to a successor in connection with a merger, acquisition, or sale of assets.
